The Equality Act 2010 generally prohibits enquiries about a job applicant’s health prior to job offer. Lengthy and intrusive ‘pre-employment’ questionnaires screened by HR or the recruiting manager are difficult to justify from a data protection perspective therefore any pre-placement or post-offer health screening must be justified and relevant for the job that has been offered.

The Information Commissioner’s Office states that ‘decisions on a worker’s suitability for a role are properly management decisions but the interpretation of medical information should be left to a suitably qualified health professional’.

Our confidential and comprehensive assessments ensure that you are compliant with data protection law whilst considering whether employees with a health condition will be able to cope with the demands of their role, whether adjustments may be required and to evaluate the risk to the individual or to others in the workplace.

Initial screening is via our secure online portal and reviewed by an OH specialist with an in-depth understanding of your workplace and relevant fitness standards. A phone call or video consultation is undertaken when further information is required, followed by an advisory report and impartial opinion on fitness for work and recommended adjustments.
